Job Summary:
In this role, you will be responsible for conducting fair, thorough, and objective workplace investigations into employee concerns, allegations of misconduct, policy violations, and other workplace matters. The role partners closely with Workforce Services, project leadership, Legal, Ethics & Compliance, and other stakeholders to gather facts, assess evidence, determine findings, and provide recommendations that support a respectful, compliant, and high-performing workplace.
The Investigator ensures investigations are conducted in accordance with company policies, legal requirements, and established investigation standards while maintaining confidentiality, impartiality, and procedural fairness. In addition to case management, the role analyzes investigation trends, identifies emerging workforce risks, and supports the continuous improvement of employee and labor relations practices, leadership capability, and workplace culture initiatives. #LI-TH1
Major Responsibilities:
- Conduct craft and non-manual employee relations investigations from intake through closure, including allegations of harassment, discrimination, retaliation, workplace violence, violations of policy, procedures or the applicable labor agreement.
- Planning and preparing for thorough investigations through interviewing and collecting evidence, applying appropriate union representation rights
- Prepares written investigation reports containing the allegations, the evidence considered, credibility assessments, findings of fact, and a policy or agreement analysis, and recommendation.
- Assists in the resolution of labor disputes, grievances, and work stoppages, and escalates matters that carry legal exposure or the potential for construction schedule delay.
- Maintains the investigations case management record, tracks case aging and outcomes, and produces periodic metrics and trend analysis for labor relations leadership.
- Research and collect data for special labor studies and drafts project communications.
- Provides advice to first-line supervision and management on industrial relations policies, investigation practice, and consistent application of disciplinary standards.
- Coordinates with Workforce Services, Project Leadership, Legal, Ethics and Compliance, and Security on matters of shared jurisdiction, and maintains the confidentiality of investigation material.
- Participates in the delivery of craft new hire orientation and in supervisor training on complaint handling and investigation awareness.
- Uses requisition tracking and employee data programs proficiently to support case work and reporting.
Supporting Activities
- Handles routine employee and labor relations inquiries related to policies, procedures, and bargaining agreements; refers to complex matters to appropriate management staff.
- Serves as the initial contact and liaison for intake and assessment of employee complaints.
- Assists with recordkeeping related to hiring, termination, leave, transfer, and promotion particularly related to Equal Employment Opportunity (EEO), affirmative action, and diversity initiatives.
- Collects information and data to assess cost and policy implications of negotiations and disputes. This may include management and union proposals, pay scales and wages, benefits, working conditions, and other mitigating circumstances.
- Maintains knowledge and understanding of laws and regulations related to EEO, affirmative action, collective bargaining, unions, labor relations, and human resources.
Education and Experience Requirements:
- Requires bachelor's degree (or international equivalent) and 5-8 years of relevant experience or 9 -12 years of relevant work experience in lieu of degree.
Required Knowledge and Skills:
- Knowledge of EEOC, ADA, harassment, FMLA, and FLSA legislation.
- Demonstrated experience independently conducting and documenting workplace investigations, including case scoping, witness and subject interviews, evidence collection and preservation, credibility assessment, and written findings applying the legislation noted above.
- Strong written communication skills, with the ability to produce concise, defensible investigation reports on schedule
- Sound judgment in handling confidential and sensitive information, and the ability to work effectively with craft, supervision and project management.
- Flexibility to be able to travel to projects and craft work locations as case work demands.
- Preferred, but not required; Prior union experience, including familiarity with collective bargaining agreements, grievance procedures, and union representation rights during investigatory interviews.
- Preferred, but not required; Bilingual language skills in English and Spanish.
